Terms and Conditions

These Terms and Conditions govern your use of AgriManage, a pesticide application record-keeping service operated by Thought Mesa LLC ("Thought Mesa", "we", "us", or "our"). By creating an account or using AgriManage, you agree to these terms. If you do not agree, do not use the service.

1. The Service

AgriManage is a record-keeping tool that helps agricultural operators log, organize, and retrieve pesticide application records. The service is provided for informational and organizational purposes only.

2. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us promptly at lee@thoughtmesa.com if you suspect unauthorized access.

3. Your Responsibilities

You are solely responsible for:

  • The accuracy and completeness of all data you enter into AgriManage.
  • Verifying that your records meet all applicable federal, state, and local laws and regulations, including pesticide record-keeping requirements under 40 CFR 171.11 and any state-level equivalents.
  • Maintaining your own copies of records you are legally required to retain. AgriManage is a convenience tool, not your system of record.
  • Ensuring that your use of AgriManage complies with all applicable laws.

4. No Compliance Guarantee

AgriManage is a record-keeping tool, not a compliance service. We do not represent, warrant, or guarantee that use of AgriManage will result in compliance with any federal, state, or local regulation, including EPA pesticide application requirements, Reentry Interval (REI) or Pre-Harvest Interval (PHI) obligations, or any other legal requirement.

All reports, records, and calculations generated by AgriManage are provided for your convenience. You must independently verify that your records are accurate, complete, and compliant with the regulations that apply to you. Thought Mesa is not responsible for any regulatory consequence, fine, or penalty arising from the use of or reliance on data in AgriManage.

5. Disclaimer of Warranties

AgriManage is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law, Thought Mesa disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, Thought Mesa's total liability to you for any claim arising from or related to these terms or your use of AgriManage will not exceed the total amount you paid to Thought Mesa in the twelve months preceding the claim.

In no event will Thought Mesa be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

7. Your Data

You own the data you enter into AgriManage. We do not sell your data to third parties. We use it only to provide and improve the service as described in our Privacy Policy.

Before closing your account, you are responsible for exporting any records you need to retain. We will give you reasonable notice before deleting account data. See the Privacy Policy for details.

8. Acceptable Use

You agree not to use AgriManage to enter false or misleading data, to violate any applicable law, or to interfere with the service or its infrastructure. We reserve the right to suspend or terminate accounts that violate these terms.

9. Billing and Payment

AgriManage is billed annually per organization. Fees are non-refundable except as required by law. We reserve the right to change pricing with reasonable advance notice.

10. Termination

You may close your account at any time by contacting us at lee@thoughtmesa.com. We may suspend or terminate your account for non-payment or violation of these terms. Upon termination, your access to the service will end. Data deletion is subject to the terms in our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or by a notice within the application before the changes take effect. Continued use of AgriManage after the effective date of revised terms constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these terms will be resolved in the courts of New Jersey.
